This document outlines the Terms and Conditions for using the Software, including the QUBO++ library and the ABS2 GPU QUBO Solver.

• Evaluation and research purposes: The Software may be used for testing, evaluation, and research purposes, provided these activities are non-commercial in nature. Any results obtained must not be utilized for profit-making purposes.
• No warranties provided: The Software is provided "as is," without any guarantees regarding its performance, quality, or suitability for specific purposes. Users assume all risks associated with its use.
• Redistribution strictly prohibited: The Software cannot be shared, distributed, or copied for use by third parties. It is intended solely for the original user's use.
• Commercial use requires prior approval: To use the Software for commercial, non-educational, or non-research purposes, prior consultation and explicit approval from the provider are required to ensure compliance with the applicable policies.

Prohibited Use Cases (Prior Approval Required)

   • The Software cannot be integrated into its workflow for production or administrative purposes.
   • The Software cannot be used for automated data processing or reporting in any organization.
2. Distribution or integration:
   • The Software cannot be incorporated into products or services offered either for free or for sale.
   • The Software cannot be hosted on a server accessible to users outside the organization, even if no direct revenue is generated.
